Terms of Service

These terms set out the agreement between you and Therapyway Ltd for use of our website at therapyway.co.uk and the Therapyway app. By visiting the site or using the app, you agree to these terms, our acceptable use rules and our privacy policy. If you do not agree, please do not use the platform.

Who we are

Therapyway is run by Therapyway Ltd, a company based at Office 8161, 321-323 High Road, Chadwell Heath, Essex, RM6 6AX, United Kingdom. You can reach us at contact@therapyway.co.uk. We run an online marketplace that connects members of the public with independent, HCPC-registered occupational therapists, speech and language therapists, and physiotherapists. We are a connection platform. We do not provide therapy, clinical care or medical advice ourselves. Where these terms say 'we', 'us' or 'our', they mean Therapyway Ltd.

Definitions

A few words have a set meaning throughout these terms.

  • Platform: the Therapyway website at therapyway.co.uk and the Therapyway app, along with the related services we provide.
  • Therapist: an independent, HCPC-registered occupational therapist, speech and language therapist or physiotherapist who publishes a profile and offers their services through the platform.
  • Client or user: anyone who uses the platform, including people searching for and booking a therapist and visitors who browse the website.
  • Content: any text, images, profile information, messages, documents, reviews or other material published, uploaded or shared on the platform.
  • Services: the marketplace features we make available, such as therapist profiles, search, messaging, bookings and payment handled through third-party providers.

Eligibility and your account

To create an account and use the platform, you need to meet a few basic requirements and look after your login details.

  • You must be at least 18 years old to create an account.
  • You must give accurate, current and complete details when you register, and keep them up to date.
  • You are responsible for keeping your password and login details secure and private.
  • You are responsible for everything that happens under your account. Tell us promptly at contact@therapyway.co.uk if you think someone has used your account without permission.

Our role as a marketplace

Therapyway connects clients with independent therapists. We give therapists a place to publish profiles and manage bookings, and we give clients a way to search for and book those therapists. We are not a healthcare provider. We do not provide therapy, supervise or take part in clinical care, and we do not give medical advice. The clinical relationship is between the therapist and their client. Decisions about treatment, suitability and care are made by the therapist and the client, not by us. We do not guarantee that any particular therapist will be available, that one will suit you, or that a booking will lead to any particular result.

If you are a therapist

If you offer your services through the platform, you take on professional and legal responsibilities towards your clients. By publishing a profile you confirm that you can and will meet them.

  • You are registered with the HCPC for the profession you practise, and you keep that registration valid for as long as you use the platform.
  • You give accurate information about your qualifications, credentials and the services you offer, and you keep it up to date.
  • You meet all professional, regulatory and legal obligations that apply to your practice.
  • You are responsible for the care of your own clients, including clinical decisions, record keeping, confidentiality and safeguarding.
  • You hold suitable professional indemnity and public liability insurance for the services you provide.
  • You set your own availability and rates, accept bookings, communicate with clients and manage your documentation and payments through the app.

We may ask you to confirm your HCPC registration and other credentials. We can suspend or remove a profile if registration lapses or if we have reasonable grounds to believe these obligations are not being met.

If you are looking for a therapist

If you use the platform to find a therapist, a few things are worth knowing before you book.

  • Please give accurate information when you create an account, search or make a booking.
  • You choose which therapist to contact and book. We do not make that choice for you or recommend one therapist over another.
  • The platform is not for emergencies. If you or someone else needs urgent help, call 999, or call NHS 111 for urgent medical advice that is not an emergency.
  • Your care is a matter between you and the therapist you book. Any questions about treatment should go to them.

Bookings, fees and payments

Therapists set their own rates, and bookings are made directly through the app. We may charge therapists a platform fee or commission for using the marketplace; where a fee applies, we will make it clear before it is charged. Payments are handled by third-party payment providers, and your use of their service is also subject to their own terms. We are not a payment provider and we do not hold your card details. Cancellations and refunds follow the therapist's own terms, together with any platform policy we publish. Please check the therapist's cancellation terms before you book.

Acceptable use

You may use the platform for its intended purpose. You must not misuse it. In particular, you agree not to do any of the following.

  • Use the platform for any unlawful, fraudulent or harmful purpose, or in breach of any applicable law or regulation.
  • Post or share content that is false, misleading, defamatory, abusive or obscene, or that infringes anyone else's rights, including intellectual property or privacy rights.
  • Scrape, copy, harvest or extract data from the platform using automated tools, bots or any similar method without our written permission.
  • Try to gain unauthorised access to the platform, interfere with its security, introduce malware, or disrupt how it normally runs.
  • Impersonate any person or organisation, or misrepresent your identity, qualifications or affiliation.

Intellectual property

We own, or are licensed to use, the platform, its software, design and the Therapyway name and brand. We grant you a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose while you comply with these terms. You may not copy, modify, distribute or create derivative works from the platform except as the law allows or we permit in writing. When you or a therapist upload content to the platform, you keep ownership of it, but you grant us a licence to host, store, display and use that content as needed to run and promote the platform. You confirm that you have the right to grant that licence and that the content does not infringe anyone else's rights.

The platform may contain links to third-party websites and rely on third-party services, such as payment providers and analytics tools. We provide these for convenience and do not control them. We are not responsible for the content, practices or availability of third-party sites or services, and a link does not mean we endorse them. Your use of any third-party site or service is governed by its own terms and privacy policy, which you should read.

Disclaimers

The platform is provided on an 'as is' and 'as available' basis. We do our best to keep it accurate and running, but we cannot promise that it will always be available, error-free or uninterrupted. We do not guarantee any clinical outcome, and we do not warrant that any therapist will suit your needs. Clinical responsibility sits with the therapist you book, not with us. Nothing on the platform is medical advice. This section does not affect your statutory rights as a consumer, and it does not limit any liability that cannot be limited by law.

Limitation of liability

So far as the law allows, we are not liable for any loss or damage that is not a reasonably foreseeable result of our breach of these terms, or for any loss arising from the acts or omissions of an independent therapist or any third party. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. If you are using the platform as a consumer, we do not exclude or limit your statutory rights.

Indemnity

You agree to cover any reasonable losses, costs, claims or expenses we incur as a result of your breach of these terms, your misuse of the platform, or your breach of any law or of another person's rights. For therapists, this includes claims that arise from the services you provide to your clients.

Changes to the service and these terms

Therapyway is an early-stage product, so we develop and change the platform over time. We may add, change or remove features, and we may update these terms to reflect changes to the platform, our practices or the law. When we make a significant change to these terms, we will update the date at the top of this page and, where appropriate, let you know. If you keep using the platform after a change takes effect, you accept the updated terms.

Suspension and termination

You can stop using the platform at any time and ask us to close your account. We may suspend or end your access if you break these terms, if the law requires it, or if we reasonably believe your use puts other users, therapists or the platform at risk. For therapists, this includes cases where HCPC registration lapses or professional obligations are not met. Where it is fair and practical to do so, we will give you notice. Sections meant to continue after your access ends, such as those on intellectual property, disclaimers, limitation of liability and governing law, will still apply.

Governing law

These terms, and any dispute arising from them, are governed by the law of England and Wales. The courts of England and Wales have jurisdiction over any dispute, although if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
